1. Charter Services

The Company provides private recreational fishing charter services departing from Amelia Island / Fernandina Beach, Florida.

Charter services may include:

Inshore fishing trips

Jetty fishing trips

Nearshore fishing trips

Offshore fishing trips

Deep sea fishing trips

Private guided fishing charters

Custom fishing experiences arranged in advance

Trip duration, fishing locations, and target species vary depending on seasonal conditions, weather, tides, and fish activity.

Fishing success is never guaranteed.

2. Reservations and Booking

Charter reservations may be made through this website, by phone, or through other approved booking methods.

A reservation is considered confirmed only after the required deposit has been successfully received and processed.

The Company reserves the right to decline or cancel any reservation request at its discretion.

Displayed availability may change until payment is completed.

3. Deposit Requirement

A $200 deposit is required to secure a charter date.

The deposit:

Reserves the requested charter date and time

Is applied toward the total charter price

Must be paid at the time of booking

If payment cannot be successfully processed, the requested time slot may be released and made available to other customers.

4. Payment Terms

The remaining balance of the charter price may be due prior to departure or on the day of the trip as specified at the time of booking.

Accepted forms of payment may include:

Credit cards

Debit cards

Cash (when applicable)

Credit card transactions may include a 4% processing fee.

Customers authorize the Company to charge the payment method provided for any applicable fees under these Terms.

5. Cancellation Policy

Fishing charters reserve a block of time that cannot easily be resold on short notice.

The following cancellation policy applies to all reservations.

Cancellations More Than 7 Days Before Trip

Cancellations made more than 7 days before the scheduled charter are eligible for a full refund of the deposit.

Cancellations Within 7 Days

Cancellations made within 7 days of the scheduled charter are subject to a charge of 50% of the total charter price.

This policy applies when:

The customer cancels the reservation

The group fails to appear

The group arrives significantly late

The trip cannot reasonably proceed due to customer delay

No-Show Policy

Failure to arrive at the designated departure location at the agreed time without prior notice will be considered a no-show.

In the event of a no-show:

The deposit will be forfeited

The charter may be charged in accordance with the cancellation policy

Early Return Requested by Customers

If passengers request to return to the dock early due to:

Seasickness

Personal preference

Weather discomfort

Lack of fish

Any other reason unrelated to captain decision

the trip will be considered completed, and no refund or partial refund will be issued.

6. Weather Policy

Fishing charters are subject to weather and sea conditions.

The Captain has sole discretion in determining whether conditions are safe to operate.

If unsafe conditions exist, the Captain may:

Delay departure

Modify the fishing location

Shorten the trip

Cancel the trip

If a trip is canceled by the Captain due to unsafe weather conditions, customers may:

Reschedule the trip, or

Receive a refund of the deposit

Safety decisions made by the Captain are final.

7. Captain Authority

The Captain has full authority over the vessel and all passengers while onboard.

Passengers must follow all safety instructions and directions provided by the Captain or crew.

The Captain may terminate a trip immediately without refund if passengers:

Fail to follow safety instructions

Engage in reckless behavior

Become excessively intoxicated

Possess illegal substances

Endanger the safety of the vessel or others

8. Passenger Conduct

Passengers must behave in a safe and respectful manner.

Passengers may not:

Bring illegal drugs or substances onboard

Bring firearms or weapons

Engage in violent or threatening behavior

Damage vessel equipment

Harass crew members or other passengers

The Captain may refuse boarding to individuals who appear intoxicated or unsafe.

9. Damage to Vessel or Equipment

Passengers are responsible for damage caused by negligence, misuse, or intentional misconduct.

This includes damage to:

Fishing rods

Reels

Electronics

Vessel equipment

Safety gear

Customers may be responsible for the cost of repair or replacement.

10. Assumption of Risk

Fishing and boating activities involve inherent risks including but not limited to:

Rough seas

Slippery surfaces

Fishing hooks and equipment

Fish spines and teeth

Weather exposure

Motion sickness

By participating in a charter trip, passengers voluntarily assume these risks.

Passengers are responsible for ensuring they are physically capable of participating.

11. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for:

Personal injuries

Illness or medical events

Loss or damage to personal belongings

Trip delays due to weather or mechanical issues

Failure to catch fish

Participation in charter services is voluntary and at the passenger's own risk.

12. Fishing Regulations

All passengers must comply with:

Florida state fishing regulations

Federal fishing regulations

Size limits and bag limits

Protected species regulations

The Captain reserves the right to release any fish required by law.

13. Photography and Media

Photos or videos taken during charter trips may be used for marketing purposes including:

Website content

Social media

Promotional materials

Passengers who do not wish to appear in promotional materials must notify the Captain prior to departure.

14. Website Use

Users of this website agree not to:

Submit fraudulent booking requests

Attempt to access restricted areas of the website

Interfere with website operation

Use automated bots or scraping tools

15. Chargebacks and Payment Disputes

Customers agree not to initiate credit card chargebacks for services rendered in accordance with these Terms.

Customers must contact the Company directly to resolve any billing issues before initiating a dispute.

Fraudulent chargebacks may result in legal action and recovery of associated costs.

16. Force Majeure

The Company shall not be liable for delays or cancellations caused by events beyond its reasonable control including:

Severe weather

Mechanical failure

Natural disasters

Government restrictions

Emergencies

17. Governing Law

These Terms are governed by the laws of the State of Florida.

Any disputes arising from these Terms or charter services shall be resolved in the appropriate courts located within Florida.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Changes to These Terms

The Company reserves the right to modify these Terms at any time.

Updated Terms will be posted on this page with the revised effective date.

Continued use of the website or participation in charter services constitutes acceptance of the updated Terms.
